DEFENSE OF STATE OFFICERS AND EMPLOYEES

Effective: August 15, 2024

Purpose: To notify University officers and employees of their right to representation in lawsuits arising from the performance of their duties.

Scope: This policy applies to all University officers and employees.

Responsible Office: President’s Office

Policy Statement: Kansas law provides for the defense of all state officers and employees when they are sued for damages for any alleged nonfeasance, misfeasance, or malfeasance while acting within the scope of their employment. The attorney general's office is authorized to provide for such defense if written notification of the filing of an action is received before the end of the 15th day after the filing date. The attorney general is not required to provide a defense when notification is received after the 15th day. Notification is transmitted through the President and the office of the Board of Regents.

Definitions: All words and phrases shall be interpreted utilizing their plain meanings unless otherwise defined in another University or Board of Regents policy or by statute or regulation.

Procedures: All procedures linked and related to the policies above shall have the full force and effect of policy if said procedures have first been properly approved by the University’s administrator in charge of General University Procedures.
